Its two most important provisions for apartment building owners are: first, it guarantees vacancy decontrol, meaning landlords can raise rent to any amount when a tenant voluntarily vacates a rent controlled unit. Second, it prohibits cities from imposing rent control on single family homes, condominiums, and buildings with a certificate of occupancy after February 1, 1995. Costa Hawkins is the reason Santa Monica landlords can reset rents to market between tenancies even though the city has strict rent control. Without Costa Hawkins, cities could potentially impose limits on what a landlord charges a new tenant.
