These Terms govern your use of the Favia Investment Group website and online materials.

These Terms of Use apply to faviainvestmentgroup.com (the "Site"). Favia Investment Group is the team name used by Don Favia for his real estate practice under Realty Investment Advisors; it is not a separate legal entity, partnership, corporation, or DBA. References to "we," "us," and "our" mean Don Favia and Realty Investment Advisors as applicable to the Site and brokerage services. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Important Dispute Notice
These Terms include provisions that affect your legal rights, including an informal 30-day dispute-resolution process, binding individual arbitration, a jury trial waiver, a class and representative action waiver, limitations on liability, and a one-year time limit for Site-related claims where permitted by law.
1. Brokerage Information
Don Favia provides multifamily investment sales, broker opinions of value, market analysis, and related advisory services under Realty Investment Advisors using the Favia Investment Group team name. Don Favia is a California real estate salesperson, DRE #01841258. Realty Investment Advisors is licensed under DRE #02063191.
2. Informational Use Only
Site content is provided for general informational and marketing purposes only. It is not legal, tax, accounting, lending, appraisal, or investment advice. Any market data, valuation commentary, cap rate discussion, or transaction information should be independently verified before you make a business decision. Consult your CPA, tax advisor, attorney, lender, appraiser, and other professional advisors for guidance specific to your situation.
No listing, valuation, rent estimate, cap rate, GRM, projected return, development discussion, or market commentary on the Site constitutes an offer, commitment, representation, warranty, or guarantee. All property information is subject to independent investigation and written transaction documents. Actual signed transaction documents control over any Site content.
3. No Client Relationship Created by Website Use
Using the Site, submitting a form, downloading materials, or contacting us through the Site does not by itself create a brokerage, fiduciary, attorney-client, tax advisory, or other professional relationship. Any brokerage representation must be documented in a written agreement signed by the appropriate parties.
4. Property Information and Availability
Listings, property details, financial information, rent data, photos, and availability are subject to change without notice. Information may come from owners, public records, third-party sources, or our own analysis. We try to keep information accurate, but we do not guarantee that all Site content is complete, current, or error-free.
5. Broker Opinions of Value
A broker opinion of value is not an appraisal and should not be treated as a formal appraisal, financing opinion, or tax valuation. It is a market-based brokerage analysis prepared from available property information, comparable sales, income assumptions, and current market conditions.
6. User Submissions
If you submit information through the Site, you represent that the information is accurate and that you have the right to provide it. You authorize us to use submitted information to respond to your request, evaluate a property, provide brokerage services, and communicate with you as described in our Privacy Policy.
Please do not submit tenant names, Social Security numbers, bank account information, government identification numbers, health information, or unredacted tenant files through Site forms. If those materials are needed for a transaction, we will discuss a more appropriate delivery method.
7. User Conduct
You agree not to use the Site to:
- Submit false, misleading, unlawful, confidential, or unauthorized information.
- Interfere with Site security, availability, forms, analytics controls, or normal operation.
- Scrape, harvest, copy, index, train on, extract, or commercially exploit Site content without written permission.
- Use bots, crawlers, scrapers, automated data-extraction tools, or AI systems to collect, copy, summarize, train on, or create datasets from Site content without written permission.
- Upload malware, automated scripts, spam, or materials that violate another party's rights.
- Use the Site for unlawful, discriminatory, harassing, or fraudulent purposes.
8. Intellectual Property and Copyright Notices
Site content, including text, graphics, logos, reports, market commentary, page design, and other materials, is owned by or licensed to Don Favia, Favia Investment Group, or Realty Investment Advisors, as applicable. You may view and print Site content for personal or internal business review, but you may not copy, republish, scrape, sell, or distribute it without written permission.
You may not use Site content for machine learning, model training, retrieval-augmented generation, automated extraction, bulk data collection, synthetic content generation, or any similar AI or data-mining purpose without prior written permission.
If you believe material on the Site infringes your copyright or other intellectual property rights, contact us with enough detail to identify the material, your claimed rights, your contact information, and a statement that the information in your notice is accurate.
9. Third-Party Links, Forms, and Tools
The Site may link to or embed third-party websites, maps, analytics tools, listing platforms, video platforms, or form processors, including providers such as FormSubmit, Google Analytics, Google Maps, and YouTube. We do not control those third parties and are not responsible for their content, terms, policies, availability, or practices.
10. No Warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Don Favia, Favia Investment Group, Realty Investment Advisors, and their respective personnel will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising from your use of the Site or reliance on Site content. To the fullest extent permitted by law, any total liability arising from Site use is limited to $100 or the amount you paid us for Site access, whichever is greater.
12. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Don Favia, Realty Investment Advisors, and their respective personnel from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, your submissions, or your violation of another party's rights.
13. Privacy and Communications
Our collection and use of personal information is described in the Privacy Policy, California Privacy Notice, Do Not Sell or Share page, and Cookie Policy.
14. Suspension, Termination, and Site Changes
We may modify, suspend, restrict, or discontinue any part of the Site at any time. We may also block or restrict access by users who misuse the Site, violate these Terms, threaten Site security, or create legal, operational, or reputational risk.
15. Governing Law, Venue, Arbitration, and Class Waiver
These Terms are governed by California law, without regard to conflict-of-law rules. Before either party starts arbitration or a court proceeding, the party raising the dispute must first send written notice describing the dispute and the requested relief. The parties will then try in good faith to resolve the dispute informally for 30 days after notice is received, unless an emergency injunction, small claims filing, or non-waivable legal right requires a faster process.
If the dispute is not resolved through that informal process, then, to the fullest extent permitted by law, any dispute arising out of or relating to the Site, online communications, or these Terms will be resolved by binding individual arbitration administered by JAMS in Los Angeles County, California, under its applicable consumer or commercial arbitration rules.
You and we each waive the right to a jury trial and agree that disputes will be brought only on an individual basis, not as a class action, representative action, private attorney general action, or consolidated proceeding. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, Site security, or non-waivable rights.
Nothing in these Terms limits any non-waivable right or remedy under applicable law, including any right to seek public injunctive relief where such a waiver is prohibited.
If the arbitration or class waiver provision is found unenforceable for a particular claim, that claim must be brought exclusively in the state or federal courts located in Los Angeles County, California, unless applicable law requires a different forum.
16. Time Limit for Claims
To the fullest extent permitted by law, any claim relating to the Site or these Terms must be brought within one year after the claim arises. This limit does not apply where a longer period is required by non-waivable law.
17. Severability, No Waiver, and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. These Terms, together with the policies linked in them, are the entire agreement between you and us regarding Site use.
18. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted means you accept the revised Terms.
